MOBU Studio · Bruce Mousset

Terms
of sale.

They apply to all services provided by Bruce Mousset, whether booked online or at the studio.

Version in force: 27 October 2026Studio: 5 rue de Lorette, 13002 Marseille, France

Art. 1Identification

Services are provided by Bruce Mousset, sole trader (French micro-entrepreneur), trading as MOBU Studio.

  • SIRET: 940 409 279 00012
  • Studio: 5 rue de Lorette, 13002 Marseille, France
  • Phone: +33 6 74 69 65 95 · Email: contact@brucemousset.com · Website: brucemousset.com
  • VAT not applicable, article 293 B of the French General Tax Code: prices are net.

Art. 2Scope

These terms of sale apply to all services offered by Bruce Mousset: photo sessions (professional portraits, personal branding, portfolios, life portraits, Escale Voyageurs), make-up (studio, weddings, training), studio prints and gift cards.

They apply to private clients (consumers) and to business clients alike, subject to the provisions specific to each.

The client accepts these terms before placing any order: online, by ticking the box provided before payment; at the studio, by signing the quote, which carries these terms on the back or on the attached sheet. The specific conditions of a signed quote prevail over these terms.

This English version is a translation provided for convenience. In the event of any discrepancy, the French version available at brucemousset.com/cgv/ prevails.

Art. 3Prices

Prices are shown in euros, net of tax (VAT not applicable). The applicable price is the one displayed on the website or stated on the quote on the day of the order.

Shooting at the studio, in the Le Panier district and in the surroundings of the studio within walking distance is included. Beyond that, a travel supplement is stated on the quote.

A quote is valid for 30 days from its date of issue.

Art. 4Booking and payment

Online booking. The client chooses a service and a time slot on the website (Cal.com booking tool), then pays the full price by bank card (secure payment by Stripe). The booking is confirmed on receipt of the confirmation email, which constitutes the conclusion of the contract.

Real-time calendar. The time slots shown are those actually available, and bookings are confirmed automatically. As the studio also welcomes walk-in clients, an unforeseen event may exceptionally lead Bruce Mousset to suggest a slight change of time or another slot. The client is informed as early as possible and may, if they prefer, ask for the session to be rescheduled or fully refunded (article 6).

Booking at the studio or by quote. The order is confirmed when the quote is signed. No deposit is required: the price is paid on the day of the session.

Accepted payment methods: bank card on a SumUp terminal, at the studio or on location; bank card remotely, through a Stripe payment link (online bookings) or a SumUp link sent by Bruce Mousset; cash at the studio, within the legal limit.

Files and prints are handed over once the full price has been paid.

Order with obligation to pay and proof. Every order, online or by quote, is an order with an obligation to pay. Online, submitting the booking form after accepting these terms constitutes signature and acceptance of the order. The records of the booking tool, of the payment provider and the emails exchanged are binding between the parties.

Art. 5Right of withdrawal (private clients)

A private client who orders remotely (website, phone, email) or away from the studio has 14 days from the conclusion of the contract to withdraw, without giving any reason and at no cost (article L221-18 of the French Consumer Code).

How to withdraw. The client sends a clear statement to contact@brucemousset.com, for example: "I hereby give notice that I withdraw from the contract for the service [name], ordered on [date], in the name of [surname, first name, address]. Date and signature." Bruce Mousset acknowledges receipt by email and refunds the client within 14 days, using the original payment method.

Session scheduled within the 14 days. If the client expressly asks for the session to take place before the end of the withdrawal period (box ticked when booking):

  • if they withdraw before the session, they receive a full refund;
  • if the session has been fully carried out, they have waived their right of withdrawal (article L221-28, 1°);
  • if the session has started, they pay for the part already carried out (article L221-25).

Exclusions. The right of withdrawal does not apply to prints and items made to the client's choices (article L221-28, 3°), nor to digital files whose delivery has begun with the client's express consent (article L221-28, 13°). It does not cover orders placed at the studio, nor business clients, except in the case set out in article 10.

Art. 6Cancellation and rescheduling

By the client:

  • one free rescheduling, if requested at least 48 hours before the session;
  • cancellation at least 48 hours before the session: full refund;
  • cancellation less than 48 hours before, or no-show: the price remains due. Rescheduling may be granted in the event of force majeure or documented illness;
  • arriving more than 15 minutes late: the session is shortened accordingly, with no reduction in price.

By Bruce Mousset (illness, unavailability, an unforeseen event at the studio, bad weather for an outdoor session): the session is rescheduled at no cost, or fully refunded if the client prefers.

Wedding services (trial and wedding day) follow the specific conditions of their quote.

Art. 7The session

Before the session, Bruce Mousset discusses with the client their needs, intended uses and the desired style. The client provides accurate information and arrives on time, with the agreed outfits.

The session is guided by Bruce Mousset, who is responsible for its art direction: framing, lighting and choice of shots.

For a session in a private location chosen by the client, the client obtains the owner's permission. A minor is photographed in the presence and with the consent of a person with parental authority.

Art. 8Selection, retouching and delivery of files

Bruce Mousset makes a first selection of the photographs, according to his eye as an author. The client receives by email a personal link to their private online gallery, where they choose their images, within the number set by their package. The gallery previews carry a watermark and may not be used. The link is personal: the client keeps it to themselves.

Bruce Mousset then retouches the chosen photographs with respect for a natural look. Retouched files are delivered in high definition, as a secure download in the private gallery, within 2 to 4 weeks of the client confirming their selection. Raw files (unretouched, RAW format) are not supplied.

The gallery is hosted in France (OVHcloud). The client backs up their files as soon as they receive them. Bruce Mousset keeps them, and the gallery remains available, for 12 months after delivery, with no obligation beyond that. Any additional retouching is subject to a quote.

Unpaid files. As long as the price has not been paid in full, the photographs are not delivered. If payment is not made after an email reminder, the photographs are permanently deleted 6 months after the session, and the price remains due.

Art. 9Studio prints and gift cards

Prints. Prints are made to order, on premium or Fine Art paper, within the time stated on the quote or order. The client checks their prints on receipt and reports any defect within 7 days. A defective print is remade at no cost.

Gift cards. A gift card is valid for 1 year from purchase, for the service it specifies or, if it carries an amount, for any service offered by the studio: its value is deducted from the price. If the service costs more than the card, the recipient pays the difference; if it costs less, the remaining balance can be used until the card expires. It is neither refundable (except under the right of withdrawal) nor exchangeable for cash. The recipient books their session online with the card's code, or by contacting the studio.

Art. 10Business clients

A business client (company, freelancer, association, production company) can order in two ways:

  • Online, at the listed price (professional portraits, personal branding…): they book and pay on the website like a private client (article 4). The content, deliverables and included uses are those of the offer and of the table in article 11. An invoice in their name is issued on request; they provide their company name and registration number when booking.
  • By quote (production companies, brands, agencies, campaigns, specific requests): they submit a request through the quote form on the website. The quote sets out the time, deliverables, rights granted and payment terms, and prevails over these terms.

For orders by quote, invoices are payable on receipt and within 30 days at the latest. Any late payment incurs penalties equal to three times the French statutory interest rate, plus a fixed recovery fee of €40 (article L441-10 of the French Commercial Code).

The right of withdrawal does not apply to business clients, except for a business with no more than 5 employees ordering outside the scope of its main activity (article L221-3 of the French Consumer Code): it then has the rights set out in article 5.

Advertising uses, paid distribution and extended licences are subject to a specific quote (article 11).

Art. 11Copyright and licence of use

Bruce Mousset is the author of the photographs and remains the owner of the rights (articles L111-1 et seq. of the French Intellectual Property Code). Payment for the service grants the client a personal, non-exclusive licence of use, not a transfer of ownership of the rights.

Uses included by service:

ServiceIncluded usesTerritory and duration
Life portraits, Escale Voyageurs, private sessionsPrivate and family use, including sharing on personal social media, for non-commercial purposesWorldwide, unlimited duration
Professional portraits, personal brandingThe client's own professional communication: website, social media, CV, LinkedIn, editorial press, printed materials for their businessWorldwide, unlimited duration
Portfolios for actors, models, artistsPortfolio, agencies, castings, the client's artistic platforms and profilesWorldwide, unlimited duration

Uses excluded without Bruce Mousset's written consent: paid advertising and campaigns, packaging and products, resale or transfer of the photographs to a third party, image banks, training of artificial intelligence, and any alteration that distorts the work (compositing, distorting filter). Cropping to fit the publication format remains allowed. These extended uses are subject to a quote.

Credit. When publishing publicly, the client credits the author where the medium allows: "Photo: Bruce Mousset · MOBU Studio", or the tag @bruce_mousset_photo on social media.

The use of the client's photographs by MOBU Studio for its own communication is governed by article 12.

Art. 12Image rights and use by MOBU Studio

The client has a right over their image (article 9 of the French Civil Code). Their photographs are also personal data (article 13).

Principle. MOBU Studio uses photographs in which the client is recognisable, for its own communication, only with their express consent. This consent is given:

  • when ordering: by ticking one of the three answers below, on the signed quote or in the online booking form;
  • or after the session: through a one-off written authorisation, signed or given by email, for specific photographs and uses.

Your photos and MOBU Studio, one box to tick

  • Yes, everywhere: portfolio and brucemousset.com website, social media of MOBU Studio and Bruce Mousset, MOBU Studio's commercial communication (advertising, flyers, posters, shop window, trade fairs, press, competitions and exhibitions).
  • Yes, discreetly: portfolio, brucemousset.com website and display at the studio only.
  • No: the photographs remain private.

No answer is pre-selected. The client may also authorise only certain photographs, through a one-off authorisation.

Scope. The authorisation applies worldwide, for 10 years from the session. It is free of charge and has no effect on the price of the service. Refusing has no effect on the service.

Withdrawal. The client may withdraw their consent at any time, by email to contact@brucemousset.com. MOBU Studio then stops any new publication and removes the online posts it controls within 30 days. Materials already printed or published before the withdrawal are not affected.

Minors. The authorisation is signed by the persons with parental authority.

Respect for the person. No use may harm the client's dignity or reputation. The photographs are never sold or transferred to third parties for commercial purposes without specific consent.

Without authorisation, MOBU Studio may only show the photographs privately, with no public distribution.

The client may access, correct or erase their data, object to its processing, request its portability or withdraw their consent, by email to contact@brucemousset.com. They may also lodge a complaint with the French data protection authority, the CNIL (cnil.fr). Details are in the website's privacy policy.

Art. 14Liability

Bruce Mousset takes all necessary steps to carry out the service properly. Artistic choices (framing, lighting, retouching, selection) reflect his eye as an author and cannot, on their own, justify a refund.

In the event of accidental loss of files before delivery, Bruce Mousset offers a new session at no cost or a refund of the service. His liability applies within the limits set by law.

Art. 15Force majeure

Neither party is liable for a failure caused by an event of force majeure (article 1218 of the French Civil Code). The session is then rescheduled by mutual agreement, or refunded if rescheduling is impossible.

Art. 16Complaints and mediation

Any complaint is sent in writing to contact@brucemousset.com. Bruce Mousset replies within 15 days.

If the disagreement persists, a private client may refer the matter free of charge to the consumer mediator, within one year of their written complaint (articles L612-1 et seq. of the French Consumer Code):

Société de la Médiation Professionnelle (SMP)
24 rue Albert de Mun, 33000 Bordeaux, France
mediateur-consommation-smp.fr · saisine@mediateur-consommation-smp.fr

Art. 17Governing law and disputes

These terms of sale are governed by French law. Failing an amicable settlement or mediation, any dispute is brought before the competent court. A private client may refer the matter to the court of their place of residence or of the place where the service was provided.

If any clause of these terms were declared void, the other clauses would remain applicable.

These terms may be amended at any time. The applicable version is the one accepted by the client when placing their order.
